Condemnation

Eminent Domain

Eminent domain is the power of government to take private property for a public use by paying "just compensation". Issues in eminent domain involve questions as to whether the taking of the private property is necessary, whether it is for a public use and whether the government's view of "just compensation" is sufficient.

Inverse Condemnation

Inverse condemnation occurs when the government does not seek to obtain title to the property, but has regulated private property to the extent that it has the same effect on the property owner as if the government formally took the property for public use.
